PUD · Guilderland, NYPlanned Unit Development (PUD) District. Purpose. The PUD District provides for flexible land use and design so that small- to large-scale neighborhoods can be developed that incorporate a variety of residential types and nonresidential uses, and which may contain both individual building sites and common property which are planned and developed as a unit. The PUD District shall include preservation of trees, natural topography and geologic features; efficient use of land resulting in smaller networks of utilities; interconnected streets; and a plan supportive of transit service and consistent with smart growth principles. Applicability. An application to rezone property to a PUD District is a voluntary action by the applicant, with approval at the discretion of the Town Board. Permitted uses. The following uses are permitted: Residential uses. All residential uses shall be allowed. Housing types should be appropriate to and compatible with the surrounding area. Nonresidential uses. All uses allowed in the Business Non-Retail Professional District (BNRP) and the Local Business District (LB) shall be allowed. Business uses should be appropriate to and compatible with the surrounding area. Requirements. A PUD application shall comply with the following requirements: Access to municipal wastewater and water infrastructure. Direct vehicular access to a county or state highway. Setbacks. Front setbacks shall meet the minimum requirements listed in the special highway access control and setback requirements in § 280-31 . Side and rear setbacks shall be established by the Planning Board through site plan approval, or may be specifically required by the Town Board, and identified on the site plan subdivision plat. Steep slope and watercourse setbacks shall meet the minimum requirements listed in § 280-30 . Open space. Adequate accommodations for parks and open space as set forth in § 280-36 shall be provided. Off-street parking and loading requirements. Off-street parking and loading areas shall be provided as listed in § 280-25 . The off-street parking requirements of two or more uses, structures or parcels may be satisfied by the same parking or loading space used jointly to the extent that it can be shown by the owners or operators of the uses, structures or parcels that their operations and parking needs do not overlap in use. If the uses, structures or parcels are under separate ownership, the right to joint use of the parking space shall be evidenced by a deed, lease, contract or appropriate written document.
