Structure Height In addition to other building or structure heigh t requirements of this Article, structure height may not exceed 35 feet for any po rtion of a structure located within the Shoreland Zone, except when the un derlying district is the R4, R5, C1, C5, M, or I District, where structure height may not exceed the building height requirement of the underlying district. Minimum Shore Frontage Except when the underlying district is the R4, R 5, C1, C5, M, or I District, minimum shore frontage is 200 feet per dwelling unit on non -tidal areas within the shoreland zone, 1 50 feet per dwelling unit on tidal areas within the shoreland zo ne overlay district, and 200 feet per lot for non -residential u ses within the shoreland zo ne overlay district. Minimum Setback [added October 28, 2009] For principal structures, water body setback measurements must be taken from the top of a co astal bluff that has been identified on Coastal Bluff maps as being “highly unstable” or “unstable” by the Maine Geolo gical Survey pursuant to its “Classification of Coastal Bluffs” and published on the most recent Coastal Bluff map. If the applicant and the CEO are in disagr eement as to the specific location of a “highly unstable” or “unstable” bluff, or where the top o f the bluff is located, the applicant may at his or her expense, employ a Maine Registered Professional Engineer, a Maine Certified Soil Scientist, a Maine Sta te Geologist, or other qualified individual to make a determination. If agreement is still not reached, the applicant may appeal the decision of the CEO to the ZBA.
