PUD · Caledonia, MISection 12.2 PUD Eligibility. A Planned Unit Development may be considered in any location within the Village of Caledonia. Any land use authorized in this Ordinance may be requested to be included in a Planned Unit Development, as a principal or accessory use, as well as any other legal land use not otherwise authorized in this Ordinance. Authorization of such use shall be at the sole discretion of the Village Council, and will be subject to adequate public health, safety, and welfare protection mechanisms being designed into the development. The following are minimum requirements for all proposed PUDs: (a) Minimum Area. In order to be considered as a PUD the proposed area of land shall be no less than five (5) acres. (b) Ownership. The tract of land for a proposed PUD project must be either in one (1) ownership or the subject of an application filed jointly by the owners of all properties included, (the holder of a written option to purchase land or the holder of an executory land contract shall, for the purpose of such application, be deemed the owner of such land). 12-2 (c) Location. Any land in the Village may be designated as a PUD in accordance with the procedures and requirements of this chapter. However, a PUD approval in the AG District shall not contain any use other than those uses permitted in the AG District. (d) Required Open Spaces . The minimum required area for open space within a PUD shall be twenty percent (20%) of the gross land area of the PUD, exclusive of any existing public right -of-way. Open space shall comply with the requirements of Section 12.3(d). (e) Public Services . The proposed type and density of use shall not result in an unreasonable increase in the use of public services, facilities and utilities, including street capacities, water and sewer capacities, fire and police services and other public services. (f) Compatibility of Project . The proposed PUD shall be consistent with the provisions of the Caledonia Village General Development Plan and with the uses and lands in the surrounding area. The development shall be consistent with the spirit and intent of the regulations contained in this Z oning Ordinance and shall not impede the continued use or development of surrounding properties for uses that are permitted in this Ordinance.
