In the Residence A, AA-1 & AA-2 Districts, the more restrictive Gateway Conservation Zone requirements do not apply when the applicant can demonstrate all of the following requirements are satified: A. The lot is 20,000 s.f. or less. B. The lot is not adjacent to or visible from the CT River. C. For the purposes of Section 58, Gateway Conservation Zone, light pollution is considered excessive, misdirected, or obtrusive light from artificial sources emanating from a site shone into the sky, onto the land or into the water column of the Connecticut River and its tributaries, including but not limited to site and architectural lighting, lighting on private residential docks, and up-lighting of trees or other site features, which may result in: brightening of the night sky, inhibiting the observation of stars and planets; light trespass onto neighboring properties including the Connecticut River; visual glare and discomfort; or significant disruptions to wildlife and ecological cycles is discouraged. This regulation is in addition to lighting regulations outlined in Section 61 and 68 of these regulations. 58.10-58.19 [r e Served ] Zoning r egula Tion S 1 74 73 72 71 70 69 68 67 66 64 63 62 61 60 59 58 57 57 55 54 53 52 51 50 49 48 47 46 45 44 43 42 41 40 158.20 c onS idera TionS for d eci Sion Within the Gateway Conservation Zone, the Commission or its agent approves a use, activity, building, structure or improvement only upon demonstration by the applicant that it meets the following general standards: 58.20.1 The proposed design preserves or enhances significant natural features and maintains or restores the natural and traditional riverway scene. 58.20.2 Site development maintains the essential natural qualities of the site, such as major landforms, natural vegetative or wildlife communities, hydrologic features, scenic qualities, or open space, that contribute to the sense of place along the Connecticut River, its tributaries or wetlands. 58.20.3 Structures adapt to the existing terrain rather than the earth altered to create a platformed development site. 58.20.4 Minimized disturbance to existing topographic forms and grading or excavation does not result in soil erosion or silting of lower slopes.
