The district regulations are designed to promote convenient pedestrian shopping and the stability of retail development by encouraging continuous retail frontage in a concentrated area. (1) The following uses are permitted by the Town Council as conditional uses subject to the provisions of Section 510 and Article 9 of the Zoning Ordinance for the Town of Burnsville and subject to a finding by the Town Council that the additional conditions listed below shall be met: (a) Any retail business conducted within an enclosed building, except as is excluded elsewhere in the zoning ordinance; (b) Banks and other financial institutions, except as is excluded elsewhere in the zoning ordinance; (c) Hotels; (d) Offices, however offices are highly discouraged on first floor storefronts; (e) Indoor Theaters; (f) Any retail business making products sold primarily at retail on the premises; (g) Restaurants, coffee shops, deli’s, eating establishments, microbrewery and distillery’s (h) Art galleries, studios and museums; (i) Personal services- Barber and Beauty Shops; (j) Residential units located above retail establishments; (k) Churches; (2) The following uses are NOT allowed in C-1 District: (a) Service Stations; (b) Stand-alone parking lots; (c) All drive in or drive through services; (d) Flea Markets; (e) Smoke Shops; (f) Thrift stores; (g) Adult uses; (h) Stand-alone bars without restaurants; (i) Any gambling uses; (j) Check cashing and payday loan businesses; (k) Laundries and Laundromats; (l) Wholesaling and warehouses operations; 37 (m) Indoor storage as a principle use; (n) Trade schools; (o) Transportation terminals; (p) Public utility facilities; (q) Mortuaries and funeral parlors; (r) Private clubs/lodges (Amended 8-20-15) (s) Tattoo/ piercing parlors.
