“B” Business District. 301.7.3 No yard, lot, or parking space now existing shall be reduced in size below the minimum requirements of this Ordinance. Yards or lots created after the effective date of this Ordinance shall meet its minimum requirements. 301.8 Uniformity: Within each district, the regulations established by this Ordinance shall be minimum regulations and shall be applied uniformly to each class or kind of structure or land. 301.9 Unaddressed Uses: Any proposed use, which is neither specifically permitted nor excluded within a zone by the Ordinance, shall be presented to the Planning and Zoning Commission before its initiation. The Commission shall review the proposed use (to determine its compatibility for the zone in which its placement is proposed) and make a recommendation as to the use’s compatibility with the Warren County Commissioners. The Commissioners, upon receiving the recommendation, shall schedule within 15 days a public hearing on the proposed use. At any regular or special meeting for general purposes following the public hearing, but in any case within 15 days of such hearing, the Commissioners shall make a final decision regarding the placement of the use in the district proposed. Both the Planning and Zoning Commission, in its recommendation, and the Warren County Commissioners, in their decision, may attach such conditions to the use as deemed necessary to protect the integrity of the zone involved. 301.10 Permitted Uses, Conditional Uses, and Special Exceptions: The permitted uses, conditional uses, and special exceptions for each district are shown in the following tables of this chapter and are considered principal uses unless noted. Conditional uses may be granted or denied by the Board of County Commissioners with the advice of the Planning Commission in accordance with the express standards and criteria of this Ordinance. In granting a conditional use, the Board of Commissioners may attach such reasonable conditions as they may deem necessary to implement the purposes of this Ordinance and safeguard the neighborhood. Special exceptions may be granted or denied 15 by the Zoning Hearing Board in accordance with the express standards and criteria of this Ordinance. In granting a special exception, the Zoning Hearing Board may attach reasonable conditions and safeguards as it may deem necessary to implement the purpose of this chapter and protect the neighborhood. Uses in each category shall be according to the common meaning of the term or according to definitions outlined in Article 6.
